Terms & Conditions

Booking and Refund Policy

1. Charter Agency Disclosure

Elysium Yachting acts as a professional intermediary (Charter Agency) between the Charterer (Client) and the Yacht Owner/Operator. When a booking is confirmed, your deposited funds are immediately committed to the specific Yacht Owner to secure your vessel and removal from the charter market. Consequently, all cancellations and refunds are strictly governed by the individual Charter Party contract provided by the Yacht Owner. By paying the initial deposit, the Charterer confirms they have read, understood, and accepted these terms and conditions in full.

2. Cancellation Schedule and Fees

To align with industry standards in the Greek charter market, the following cancellation fees apply to all Bareboat, Flotilla, and Skippered Charter services:

  • Cancellation 90+ Days Before Departure: The 50% deposit is retained as a cancellation fee. We will attempt to recover any balance paid above this 50% from the Yacht Owner.

  • Cancellation 45 to 90 Days Before Departure: The 50% deposit is retained. Any additional payments are subject to the specific Yacht Owner’s recovery policy.

  • Cancellation LESS than 45 Days Before Departure: 100% Cancellation Fee. Within this window, the full charter fee is non-refundable as all funds have been committed to the Yacht Owner and operational logistics.

3. The Pass-Through Refund Guarantee

Our commitment to our clients is transparent: If the Yacht Owner returns the funds to us, we pass them directly back to you. * Agency Support: In the event of a cancellation, we will actively negotiate with the Yacht Owner on your behalf to recover the maximum amount possible.

  • Administrative Fee: Any authorized refund is subject to a €150 administrative fee to cover processing, bank charges, and credit card transaction fees.

4. Postponements and Re-Booking

Requests to change dates or vessels are considered a cancellation of the original contract. While we will petition the Yacht Owner to move your booking or issue a “Credit Note” for future seasons, this is entirely at the Owner’s discretion and may involve a rescheduling fee.

5. Inclement Weather and Health

If a charter is interrupted or cancelled due to weather conditions or personal illness after the commencement date, we are unable to offer any refund as all rental costs have already been transferred to the owners. Elysium Yachting strictly mandates that all Charterers purchase Comprehensive Travel & Cancellation Insurance to protect their investment against these risks.

6. Refund Application Process

All cancellation requests must be submitted in writing to [email protected].

  1. Verification: We will contact the Yacht Owner to establish the refundable amount based on your specific Charter Party contract.

  2. Notification: You will be notified via email of the Owner’s decision and the breakdown of recoverable funds.

  3. Payment: Once the Yacht Owner returns the funds to Elysium Yachting, a credit will be applied to your original method of payment.

7. Jurisdiction

Any disputes arising from this agreement shall be governed by Greek Law and settled in the competent courts of the local jurisdiction of the vessel’s base.

8. Late or Missing Refunds

If your refund was authorized by Elysium Yachting, but you haven’t received a refund yet within 10 business days,:

  1. Check your bank or PayPal account again, depending on your method of payment.
  2. Contact your credit card company, it may take some time before your refund is officially posted.
  3. Contact your bank. There is often some processing time before a refund is posted.

If you’ve done all of this and you still have not received your refund yet, please contact us at [email protected].

9. Bank Charges and Currency Conversion Rates

All refunds are issued in the original currency of the transaction. Elysium Yachting is not responsible for losses incurred due to currency exchange rate fluctuations or additional fees charged by the Charterer’s receiving bank.

10. Liability and Indemnity

Elysium Yachting acts solely as an agent and is not the owner, operator, or carrier of the vessels provided.

  • Passenger Safety: The Charterer and all passengers travel at their own risk. Elysium Yachting is not liable for any personal injury, illness, death, or loss of personal property occurring during the charter, whether caused by negligence of the crew, vessel defects, or maritime accidents.

  • Vessel Damage: The Charterer is responsible for any damage to the yacht, its equipment, or third-party property caused by their own negligence or willful misconduct. In Bareboat charters, this liability is typically limited to the amount of the Security Deposit, unless the damage is caused by gross negligence or a breach of the Charter Party terms.

  • Indemnification: The Charterer agrees to indemnify and hold harmless Elysium Yachting against any claims, losses, or legal expenses arising from the Charterer’s (or their guests’) actions while on board or during transit to/from the vessel.

11. Skipper and Crew Responsibility

  • Professional Skippers: When a skipper is provided, they are responsible for the safe navigation of the vessel. However, the skipper is not a lifeguard or childminder. The safety of passengers while swimming, diving, or using water toys is the sole responsibility of the passengers.

  • Skipper’s Orders: For the safety of the vessel and all on board, the Skipper’s instructions are final. Failure to follow safety instructions may result in the immediate termination of the charter without a refund.

  • Bareboat Responsibility: In Bareboat charters, the designated Skipper is legally and financially responsible for the vessel and the safety of all crew members.
